Agreement

These terms are an agreement between you and SparkBrain Labs, Inc., based in the USA ("SparkBrain", "we", "us"). By creating an account or using SparkBrain you accept them and our Privacy Policy. If you do not accept them, please do not use SparkBrain.

Who can use SparkBrain

  • Accounts are for adults: you must have reached the age of majority where you live (18 in most places; 19 in some Canadian provinces and US states; 20 in New Zealand; 21 in Mississippi).
  • Children use SparkBrain only through a profile their parent or guardian creates and controls. You confirm you are the parent or legal guardian of each child you add, or have their parent's authority to add them, and you give the consent described in our Children's Privacy Notice.
  • You are responsible for what happens in your account and in your children's area, and for keeping your password and sign-in methods safe.

Your family account

  • The parent who creates a child's profile is its primary guardian and may invite other adults as co-guardians. Every guardian has full access to that child's profile.
  • Information you enter must be accurate. Keep your contact email up to date — we use it for security and billing messages.
  • You may delete a child's profile or your whole account at any time in Settings.

Subscriptions and payments

  • Some features need a paid subscription. Prices, the included parent and child places, and extra places are shown before you pay. Taxes may apply.
  • Subscriptions renew automatically at the end of each period until you cancel. We send you a reminder 10 days before a renewal.
  • You can cancel at any time in Settings → Subscription; access continues until the end of the paid period. Payments are not refundable except where the law requires (for example, a statutory cooling-off period) or where we say so.
  • If a payment fails we will tell you and retry; access may be limited until it succeeds.
  • We may change prices with at least 30 days' notice before your next renewal; you can cancel before the change applies.
  • Payments are processed by Stripe under its own terms.

Acceptable use

Do not:

  • use SparkBrain against the law or to harm, harass or exploit anyone, especially a child;
  • add a child you have no authority to add, or information about another person without their permission;
  • try to get into accounts or data that are not yours, test or break our security (report weaknesses to security@sparkbrain.net instead), or overload the service;
  • copy, resell or reverse-engineer the app, or use automated means to access it;
  • upload anything unlawful, hateful or sexually explicit.

We may remove content or suspend accounts that break these rules, and we report suspected child exploitation to the authorities.

Your content

The lists, rewards, notes and other content you create remain yours. You give us permission to store and display it only to run SparkBrain for your family. You are responsible for it.

Our app

SparkBrain, its design, texts, icons and software belong to us or our licensors and are protected by law. We give you a personal, non-transferable licence to use the app while your account is active. Feedback you send us may be used to improve SparkBrain without obligation to you.

Changes and availability

We keep improving SparkBrain and may change or stop features. We aim to keep it available but cannot promise it will always be uninterrupted or error-free. If we change these terms in a way that matters, we tell you by email and in the app before the change takes effect; continuing to use SparkBrain after that means you accept the new terms.

Ending your account

You may stop using SparkBrain and delete your account at any time. We may suspend or close an account that breaks these terms or the law, after telling you why where we can. What happens to your data is described in our Privacy Policy.

Disclaimers

SparkBrain helps families organise routines and rewards; it is not a substitute for parental supervision, professional education, medical or psychological advice. Points and rewards have no cash value — the money value shown is only a family convention. To the extent the law allows, SparkBrain is provided "as is", without warranties of any kind.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost data or profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer where you live.

Law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Courts in Delaware have jurisdiction, except that, if you are a consumer, you may also bring a claim in the courts where you live and keep the protection of the mandatory consumer laws of your country or province (including Québec and Brazil). Before going to court, please write to legal@sparkbrain.net so we can try to solve the problem together.
